Costello, Mains & Silverman recently filed suit on behalf of a Woodbridge Township police department officer alleging military status and gender discrimination. While it is upsetting that such instances occur on the job, Costello, Mains & Silverman remains committed to advocating for all victims of workplace discrimination. In this matter, we look forward to allowing the judicial process to take its course.

In a case filed in June in New Jersey a woman alleges Amazon fired her from one of its warehouses for taking frequent bathroom breaks. The woman attributes the breaks to irritable-bowel syndrome.

In one of the first in-person trials since the March 2020 Covid-19 shutdown, a Cape May County jury awarded a woman $605,000 Monday for her defamation claim.
The Plaintiff, Jacqueline McDade, is a Wildwood Crest business owner, who leased space from a local business person, Steven Paglione and his company P&P Associates. Ms. McDade alleged that after a dispute about the property, Mr. Paglione made numerous false and defamatory comments about her to people she knew and conducted business with. The alleged comments included false statements of a sexual nature.
After a five-day trial, an in-person jury found that Mr. Paglione defamed Ms. McDade, and awarded her $605,000 in damages. The jury awarded $105,000 for emotional distress and $500,000 in punitive damages. The law office of Costello, Mains & Silverman, LLC represented Ms. McDade, and tried the case.

“Until this decision, there were certain employers who maintained, as part of their defense to failure-to-accommodate claims, that as long as there was no adverse job action that came as a result of a failure to accommodate, the failure to accommodate essentially disappears,” Kevin Costello, a partner at Costello, Mains & Silverman in Mount Laurel, said. “It was the ‘no harm, no foul’ argument. This decision puts that argument to bed forever.”

Tyrone Gee, the city’s supervisor of street monitoring, allegedly told a female subordinate that he wanted to “lick her up and down” and make “love to her,” according to a newly filed lawsuit.
The complaint, naming the city and public works department, was filed by attorney Kevin Costello. He declined to comment beyond the pleadings.
His firm represented several women who were sexually harassed by former Mercer County airport boss Stanley Patterson.

The New Jersey Supreme Court has ruled unanimously that a construction company must pay for an injured employee’s medical marijuana expenses.
Costello, Mains & Silverman LLC Attorney and Partner Kevin Costello commented that employers trying to avoid covering the costs of medical marijuana on a worker’s compensation claim will have a difficult time getting out of that.
“If there are any questions that are still pending in the appeals process that are identical to this, this decision should resolve those issues,” he said.

This week’s Supreme Court decision in Bostock v. Clayton County will provide additional protection in some areas outside the reach of New Jersey’s Law Against Discrimination. In a recent NJ Law Journal article on the consequences of the Court’s decision, partner and employment lawyer Kevin Costello was a featured contributor. A state Appeals Court has ordered the Trial Court to conduct further inquiry into a previous order requiring the Jersey City Police Department to undergo annual training on transgender discrimination as a remedy for its discriminatory treatment of a man in custody.
The order was granted after a successful trial in which Costello, Mains & Silverman, Employment and Civil Rights attorneys, represented Shakeem Holmes. Mr. Holmes, a man of transgender experience, was found by a jury to have been discriminated against by the Jersey City Police, while in custody, on the basis of that status. The JCPD did not challenge the verdict, but did challenge the equity order by the Trial Court.
Commenting on the Appellate Court decision, partner Kevin Costello, who tried the case for Holmes, said: “we see this decision and the remand as an opportunity to dive more deeply into an issue which has received precious little attention in public discussion and discourse, which is the transgender experience. We look forward to it.”

Founding member Kevin M. Costello has been named as a Trustee to the Camden County Bar Association (CCBA). Kevin will serve a three year term.
“The CCBA was my first bar organization after I left law school,” Kevin says. “It was basically my “cradle” for the first years of my practice. It’s a great organization. Now that I am concluding my year as President of the New Jersey Association for Justice, I look forward to serving an organization that has meant so much to me over the decades of my practice.”

Jury Awards $75,000 To Corrections Officer After She Was Retaliated Against For Complaining About Harassment
TRENTON, N.J. – February 7, 2020 – A Mercer County Jury found the New Jersey Department of Corrections retaliated against a female corrections officer for making race and gender harassment complaints and awarded her $75,000.
Senior Corrections Officer, Jennifer Schiavone, filed a lawsuit under the New Jersey Law Against Discrimination against the Department of Corrections in 2017. In that lawsuit, she alleged that she made complaints starting in 2016 that she was subjected to a hostile work environment because of her race and gender. She alleged that her supervisors at the Department retaliated against her for making those complaints.
On February 5, 2020, after a three-week trial, a jury found that the Department had in fact retaliated against Officer Schiavone for making the harassment complaints. The jury awarded her $75,000 in emotional distress damages resulting from the retaliation. Officer Schiavone was represented by the civil rights law firm of Costello, Mains & Silverman, LLC. The case was tried by a partner at Costello, Mains & Silverman “We are proud of this result for Officer Schiavone, who was the victim of cruel and unwarranted retaliation. We hope that a clear and loud message has been sent to all employers, public and private, that retaliation is never acceptable and justice will hold them accountable for their actions,” said Kevin Costello, the founding partner of Costello, Mains & Silverman.

The lawsuit was filed on behalf of two former students. The complaint filed with the Superior Court of Camden County says that the boys’ program was created in 2013 or 2014 and there was not an option for girls.

Costello, Mains & Silverman partner Kevin Costello testified before the New Jersey Assembly Consumer Affairs Committee on three Bills which support the right of consumers and employees to have a trial by jury instead of being forced into unfair arbitration. All three Bills, requiring fairness and transparency in the arbitration process, were voted out of committee and will go forward. The firm is proud of Kevin’s service to the people of New Jersey both as an attorney representing individuals and as an advocate for fair and just law and social policy.
Costello, Mains & Silverman, LLC has once again attended the New Jersey Association for Justice Meadowlands Seminar from November 14 – November 16, 2018. Not only have our attorneys attended this seminar for many years, they also participate as speakers and chairs of committees.
This year, partner Kevin Costello was the employment chair of the seminar, while partner Deborah Mains chaired the charity event as well as co-chaired the Turkey Drive for the southern region of New Jersey. As well, partner Daniel Silverman continued to present the “Top Ten in Employment Law Update”, while our new associate, Jacquelyn Matchett, co-chaired the Technology for Litigators seminar, as well as co-chaired and presented at the Minority Trial Lawyers Caucus Luncheon.

On October 16 and October 17, 2018, Kevin Costello, founding partner of Costello, Mains & Silverman, LLC, sat on a panel for a Camden County Bar Association Seminar related to students with emotional problems.
The seminar focused on both the special education and civil liability school district’s may have related to students suffering from emotional problems, including when the students’ emotional problems become the school district’s responsibility and what steps the school district must take.
Kevin spoke on the topic of liability for school districts related to emotionally challenged students. He touched on the duty to protect and accommodate said students, the duty to protect students from known dangers, as well as bullying and harassment.
Partners Kevin M. Costello joined other attorneys from the New Jersey Association for Justice at the Rutgers University Law School first year activities fair at the Camden Campus.
As President-Elect and NJAJ, Kevin frankly explains why it’s important for NJAJ attorney members to help increase the numbers of the Rutgers student chapter of NJAJ: “if we don’t replace ourselves with energetic young attorneys ready to continue the fight for social and civil justice, the people of New Jersey will have no advocates against oppression, discrimination, workers’ rights abuses, corporate greed and unsafe products.”

On March 13, 2018, a jury awarded Jose Reyes $212,880 in his discrimination lawsuit against Camden County. Mr. Reyes, who works for the Camden County Highway Department, alleged that he was subjected to a racially hostile work environment when his supervisor used racial language in the workplace including referring to himself as the “head nigger in charge.” He alleged that his supervisor assigned more favorable jobs to white employees over minority employees. Finally, he also alleged that Camden County retaliated against him when the County suspended him on multiple occasions after he filed his initial lawsuit.
The jury found that Mr. Reyes was subjected to a hostile work environment, and retaliated against for filing his initial lawsuit. The jury awarded Mr. Reyes $200,000 in emotional distress damages, and $12,880 in economic damages for the unpaid suspensions. Mr. Reyes was represented by Costello, Mains & Silverman, LLC attorney.
On March 1, 2018, Deborah Mains was honored by the New Jersey Association for Justice (NJAJ), receiving the 2017 Professional Lawyer of the Year Award presented by the New Jersey Commission of Professionalism in the Law, as well as being honored for contributing to the NJAJ Amicus Advocates. We are very proud of Deborah for receiving this award in recognition of her strong work ethic and dedication to her practice.
Deborah L. Mains spoke at the National Employment Lawyers Association-New Jersey Dinner and Networking meeting at the Hyatt Regent. The topic was How to Write Winning Briefs: Defeating Motions to Dismiss, Summary Judgment and Winning Appeals. “It was an honor to be invited to speak at this event along with Richard Schall, Esq.”, Deborah commented, “Speaking on a topic which is tremendously important to a successful practice is as much a learning experience for me as a teaching experience. I enjoyed myself tremendously and hope all attendees did, too.”
On January 18, 2018, Kevin Costello, founding partner of Costello, Mains & Silverman, LLC, sat on a panel for a Burlington County Bar Association seminar entitled “Spinal Surgery, Employment Law Issues & Case Update.” Kevin spoke on the topic of the intersection of employment law and workers’ compensation law.
“Many of our clients’ cases have overlapping employment and workers’ compensation aspects”, said Kevin, “and I’m grateful to the Burlington County Bar Association for giving me the opportunity to educate other attorneys and legal professionals on this important topic.”

“It’s so important to educate young lawyers about what it truly means to be a plaintiffs’ attorney,” says Kevin. “Being a plaintiffs’ attorney is an incredible opportunity to protect the rights of our fellow citizens and to be an advocate for clients who have suffered from any form of injustice.”
On June 15, 2017, a Mercer County jury awarded former corrections officer, Shelley Pritchett, a verdict of over $11.8 million dollars. Ms. Pritchett was represented by Costello, Mains & Silverman, LLC attorney. Ms. Pritchett was a corrections officer with the Juvenile Justice Commission (“JJC”) for five years when she was diagnosed with multiple sclerosis. When Ms. Pritchett requested a brief medical leave of absence to undergo treatment, the JJC denied her request and forced her to take a disability retirement. Despite Ms. Pritchett’s numerous requests to return to work, the JJC refused to allow her to return.
After a two-week trial, the jury entered the $11.8 million verdict, which included $1,249,111 for past and future economic damages, $575,000 for emotional distress and $10 million for punitive damages.
On May 23, 2017, Kevin Costello, founding partner of Costello, Mains & Silverman, LLC, sat on a panel for the Camden County Bar Association Seminar on Special Education Disputes. Kevin spoke of the intersection between education rights, which arise under administrative law, and civil rights, which are under the State/Federal law and also discussed the New Jersey Law Against Discrimination. Kevin also went into detail about the relationship between schools, students and issues with special education.
“A lot people don’t realize that schools can be guilty of discrimination,” says Kevin, “Parents have an opportunity to not only enforce education plans administratively, but also to hold the school accountable under the civil rights laws.”
On May 17, 2017 ,Kevin Costello, founding partner of Costello, Mains & Silverman, LLC, sat on a panel for a Camden County Bar Association Seminar and spoke on ” New Jersey Employment Rights: What Are They Anyway?” This seminar was geared towards educating attorneys with little to no employment law experience, correcting some myths as to what is and isn’t legal with employment in our State.

The firm is deeply gratified to announce an important victory before the New Jersey Supreme Court in the matter of Puglia v. Elk Pipline. Lower courts had dismissed Mr. Puglia’s claim that he was terminated in retaliation for objecting to illegal wage practices, ruling that his claim should have proceeded under federal labor law. The lower court rulings would have denied Mr. Puglia the protection of our New Jersey Whistleblower law simply because of his union membership. We continued to fight for Mr. Puglia, taking his case to the New Jersey Supreme Court, which overturned the lower court rulings and allowing Mr. Puglia to try his case before a jury.
On October 4, 2016, Kevin Costello, founding partner of Costello, Mains & Silverman, LLC, sat on a panel for a Camden County Bar Association seminar entitled “Effective Strategies for Developing and Maintaining Business.” Kevin spoke on the topic of establishing and maintaining client relationships, discussing ethics and fee agreements, referral fees, initial client contact and client retention issues.

On May 16, 2016, Deborah L. The segment was on Bullying in the Schools. “Bullying isn’t a new topic, it’s just expanded in a way that never before seemed possible with advancements in technology,” says Kevin. “Technology has made it easier to bully. You don’t have to be face-to-face anymore to be a bully. With a click of a button you can become a bully and in an instant, make someone a victim. That, unfortunately, carries over to the school atmosphere but, with the proper actions taken by school administrations and with diligent and attentive parents, we can hope for a decrease in school bullying.”
The topic of school bullying was discussed for the entire segment. “It was an honor to appear on Dr. Nace’s show and I look forward to future appearances on such important subjects.”

CLE Seminar – What Non-Employment Lawyers Need to Know

We at Costello, Mains & Silverman share the joy and pride that tens of millions of our fellow American are feeling as we hear about this historic decision. As expected, the decision was 5 to 4, and it runs the anticipated ideological lines. We’ll have more once we’ve analyzed the decision and the dissents. For now, however, the United States moves one step closer to a society in which bigotry is against our national law just as it is an affront to our national conscience.

On December 8, 2014, Kevin Costello testified before the New Jersey State Senate Labor Committee in support of Bill S280, also known as the “Healthy Workplace Act.” This is an Act which would render many types of workplace abuse which resulted in significant physical or emotional injury illegal and actionable. “New Jersey has to have the courage to pass this Bill, which according to recent surveys, is supported by more than 90% of workers polled,” says Kevin. “Workplace bullying is an epidemic. The interview is in follow-up to an article regarding a complaint that was recently filed against Williamstown School District and a 6 th grade female student alleging severe sexual harassment. “Bullying and harassment is far more damaging than it ever was, and it’s getting worse, because technology makes it worse,” Kevin said. “It’s far easier to recruit help, far easier to socially ostracize the victim and far more daunting, although not impossible, for parents and schools to control behaviors.” Kevin continued, “To stop the problem, you have to stop kids from thinking these things are okay, to make sure that early on, if kids are engaging in this conduct, it’s required that kids be subject to discipline.”

There are several contributing factors to the uptick of wage-and-hour suits, including the 2008 recession and an ongoing discourse over raising the minimum wage. Additionally, today’s workers are more inclined to pursue legal matters because they are more informed due to websites and news reports about large verdicts and settlements. “The Internet has been a huge resource that has allowed more people to know something general about their employee rights that 10 or 15 years ago they wouldn’t have a reason to know at all,” says Kevin.
Employers’ improper categorizing of workers as overtime-exempt has also contributed to the rise in wage-and-hour suits. “I think the culture is that employers feel empowered and emboldened to try any trick they can think of to increase profits,” says Kevin. Greenstein, a keynote speaker at an anti-bullying “summit” which took place at Rutgers Law School in Newark, called “Workplace Bullying: Seeking Solutions.” Other speakers included educational, health and union professionals. “The purpose of the event,” Kevin says, “was to raise awareness of workplace bullying in New Jersey and throughout the nation. Recent surveys suggest that between a quarter and one half of all working people have experienced workplace bullying. It’s an epidemic which hurts not only the victims, but also the economy as a whole.”
Kevin’s keynote address was in support of New Jersey’s “Healthy Workplace Act,” a bill proposed by Senator Greenstein, which would make severe workplace bullying that resulted in mental or physical illness an employment-rights violation in New Jersey. “It would be the first of its kind in the nation,” Kevin says, admitting that the road to passing such a law is a hard and steep one. “Yet New Jersey has always protected workers’ rights, and this is a bill whose time has come, just as, in the past, the time for child labor laws, OSHA laws and laws protecting equal pay for women came. There was opposition then, but it was the right thing to do, and this is, too. I was proud to be a part of this, and to support the initiative, the event, and the Healthy Workplace Act.”

The suit alleges that Ms. Gray was pulled over while driving through North Bergen and was humiliated by the manner in which she was handled by the police, for example, being called “sir” despite the fact that her license said “female” and despite her appearance as a young woman.
“New Jersey’s Law Against Discrimination prohibits discrimination based upon gender identity or expression,” says Kevin, “which means that, in the eyes of the law, she’s a woman when she says she is. And once she declares that’s who she is and that’s how she presents herself, the police are obligated to treat her that way regardless of what her license marker says. “In the eyes of the Law Against Discrimination, she’s a woman,” Kevin adds.

Wins Sexual Harassment Trial in Camden County

, obtained a $150.000.00 verdict in a sexual harassment trial concluded in Camden County, New Jersey, on February 7, 2014. “We’re very proud of the result,” Kevin says, “because this case was hard-fought. At no time did these defendants want to discuss settlement, and they were aggressive in offering witnesses and evidence suggesting the harassment didn’t occur.
The case involved sexual and racial harassment directed at a female server by her employer, the owner of a south Jersey dining establishment. “Some pretty awful language was at issue,” Kevin says, “though the defendant, along with his witnesses, denied that it happened.” As well, the plaintiff in the matter contended that she was discharged in retaliation for resisting the harassment, and that she lost several weeks of work as a result. The final verdict was in the amount of $50,000.00 in compensatory damages and an additional $100,000.00 in punitive damages. An application for additional damages for the plaintiff’s attorney fees is also pending.

New Jersey Employment Rights Attorney Discusses Raising the Minimum Wage
In the November elections, NJ voters voted, with 61% in support, to amend the NJ State Constitution to increase the minimum wage, effective January 1, 2014, from $7.25 per hour to $8.25 per hour. The amendment will also require annual increases to the minimum wage in the event of a cost of living increase. NJ has become just the fifth state in the union to make the minimum wage a matter of constitutional mandate.

It’s a ‘no-brainer,’ since I don’t believe anyone could reasonably suggest that it’s ‘OK’ to sexually harass a female intern simply because she’s not collecting a paycheck. The interview concerned recent filings regarding school harassment and bullying, including the case of J.F. v. West Deptford Public Schools. “We’ve seen a steady increase in these types of cases,” Kevin says, “and technology isn’t helping. It’s become very easy to passive-aggressively harass someone remotely using social media and applications that allow false video and pictures. The specific types of homophobic, sexual and racial harassment we’re seeing is often devastating to the kids affected, as well as to their families. It destroys school morale and can destroy lives.”

Wins CEPA Trial in Ocean County
On October 10, Kevin and his co-counsel took a CEPA verdict for their client in a tough-fought matter under the New Jersey Conscientious Employee Protection Act, also called New Jersey’s “whistleblower” law. “We’re very pleased,” Kevin says of the verdict. “This was a case in which there was no quarter asked, and none was given. The defense refused to talk settlement and was of the firm belief they’d be able to convince the jury that our client was fired for non-retaliatory reasons. We disagreed, and we prevailed. Our client is pleased to have been vindicated by the jury.”

As a civil rights lawyer and long-outspoken supporter of equal rights under the law, I celebrate and support the Court’s decision.”

Preserves $2.14 Million Verdict

members Deborah L. Mains and Kevin M. Costello argued in opposition to a motion for a new trial in the matter of Doculan v. Bayonne Medical Center and won the day, preserving the significant verdict in Conscientious Employee Protection Act (CEPA) case obtained in a trial by Kevin in Hudson County in May. “We’re very proud of the verdict, of course,” says Kevin, “but having had the motion to set the jury’s verdict aside properly denied by the Court is gratifying. It demonstrates the respect for the jury’s deliberative process and the right of a trial by jury.” Deborah adds: “Our client is very happy with the result.”

Files Appeal of the “Borgata Babes” Dismissal
The firm fought – and for the moment, lost – a motion to dismiss the suit on behalf of a score of “Borgata Babes” cocktail servers who claim discrimination at the hands of the casino emerging from appearance policies. The contention in the case is that requiring a certain type of sexualized appearance for a job which should not fairly require such is a violation of New Jersey’s Law Against Discrimination. The casino asked the Court to dismiss the case on the grounds that the policy is not discriminatory, and the Court agreed. “We respectfully believe the decision was wrong,” says member

, who authored the brief and undertook the argument, “and we plan to appeal, because we believe that sexualizing a job is a form of gender discrimination illegal under state law. We will not give up this fight until it’s through the process.”
