Familial Status Discrimination
Pregnancy discrimination is prohibited under the New Jersey Law Against Discrimination, under the prohibition of discrimination based upon “familial status.” In addition, in order to support family obligations, the New Jersey Family Leave Act (NJFLA) and the Federal Family and Medical Leave Act (FMLA) offer mandatory leave protection, for qualified employers and employees, of up to 12 weeks, to welcome the birth or adoption of a child or to offer care for the medical needs of your children.
Some employers also make moral choices for their employees and judge the choice to adopt, to become a single parent, or otherwise discriminate against employees on the basis of choices concerning the raising of a family.
