Did your employer ask you to resign?

There are many circumstances that can result in your employer asking you to resign. For example, if you aren’t seeing eye to eye with management, the company may ask you for your resignation as opposed to terminating your employment.

If you find yourself in this situation, it’s critical to understand why your employer is taking this action and what you can do to protect your legal rights. For example, here are some questions you need to ask and answer:

  • What impact will a resignation have on benefits such as health insurance?
  • Will resigning, as opposed to being terminated, affect your eligibility for unemployment compensation?
  • Will you be eligible for a severance package?

It’s critical to discuss these questions, among other concerns, with your human resources department. If you neglect to do so, you could make a decision that negatively impacts your future employment and finances.

If you’re asked to resign, you have the power to negotiate the terms and conditions of doing so. For instance, your employer may not have had intentions of offering a severance package, but it’s within your rights to negotiate this. You can also discuss compensation for unused personal time, vacation time and sick days.

When your employer asks you to resign, they do so because it’ll benefit them in one or more ways. They don’t typically do so because it’ll help your situation.
