Collect evidence of sexual harassment in the workplace

As a victim of sexual harassment in the workplace, you don't want to find yourself in the middle of a "he said, she said" standoff. The best way to protect against this is to collect evidence associated with your claim.

With the right evidence backing up your claim, it's much easier to prove that you were the victim of sexual harassment. Here are some things you may be able to collect:

  • Crude emails, text messages, letters or photos: For example, if the harasser sent you a crude email, print it out so you have a hard copy for your records.
  • Statements from co-workers: Maybe someone in your department was within earshot when your supervisor made a derogatory comment or touched you inappropriately. Ask them to provide you with a statement regarding what they heard or saw.
  • Evidence of harassment against others: Your harasser may make it a habit to harass multiple people throughout your office. If you have evidence backing this up, it's also important to your case.

Along with the above, keep detailed notes about when and where the harassment occurred.

With the right evidence in hand, it's easier to file a formal complaint of sexual harassment with your human resources (HR) department. It also shows them that you are serious about taking action, which puts you in a position of power.

If your HR department neglects to take you seriously, it's time to look into other options. You may need to take your case to the U.S. Equal Employment Opportunity Commission (EEOC) in order to get the justice you deserve. An experienced attorney can provide valuable support and guidance.
