Make sure you receive your final paycheck from your employer

It doesn't matter if you leave your job voluntarily or are terminated for any reason, it's important to understand your legal rights and how to protect them. For example, you're entitled to receive your final paycheck in a timely manner, so you shouldn't let your employer off the hook.

Employers are not required by federal law to immediately issue a final paycheck. However, it's important to note that every state, including New Jersey, has a law in place to protect you.

Unlike some states, New Jersey has the same law for fired employees and those who quit. Employers are required to issue payment on the next scheduled payday.

What to do if you don't receive your paycheck

Even though you know when to expect your paycheck, it doesn't necessarily mean it will arrive. Maybe your employer forgets to do so, as you're no longer an employee. Or maybe your employer makes the conscious decision to withhold this money, as they believe they have the legal right to do so.

If this happens, start by contacting the HR department. Explain your situation and let them know that you didn't receive your final paycheck. There may be an honest reason for the oversight.

If your employer continues to fight back, neglecting to provide you with your final paycheck, don't hesitate to put your request in writing while you learn more about your legal rights.

It's not something you want to do, but if your employer doesn't comply with your final request you may need to take legal action to receive the money you're entitled to.
