Sexual Orientation Harassment

Sexual orientation is not a protected classification under federal law. The Employment Non-Discrimination Act – ENDA – which is meant to offer this protection, has not yet been passed. Luckily, the New Jersey Law Against Discrimination does offer protection from discrimination on the basis of sexual orientation.

You have the right to be who you are, to love whom you love, and to maintain your dignity and identity at work and in school. You have the right to be free of discrimination and harassment, which is the creation of a hostile, abusive or intimidating working environment, when that environment or discrimination is based upon your sexual orientation, gender expression or gender identity, or your perceived sexual orientation or LGBT status.

Abusive name calling, references to sexual stereotype behavior and denigrating names for sexual minorities, as well as threats and intimidation, are just some of the ways in which LGBT workers and students are harassed at work and in school.

The attorneys at the South Jersey law firm of Costello, Mains & Silverman, LLC have brought claims throughout the state of New Jersey to protect LGBT and GLBT workers and students from hostile, intimidating and abusive working environments for nearly 30 years.

Be who you are, and we’ll do the rest. Please call Costello, Mains & Silverman, LLC today at 866-944-3371 (toll-free) or contact us online to arrange a confidential consultation.
