June 15 , 2017

Drake-Bearden

On June 15, 2017, a Mercer County jury awarded former corrections officer, Shelley Pritchett, a verdict of over $11.8 million dollars. Ms. Pritchett was represented by Costello & Mains, LLC attorney Drake P. Bearden, Jr. Ms. Pritchett was a corrections officer with the Juvenile Justice Commission ("JJC") for five years when she was diagnosed with multiple sclerosis. When Ms. Pritchett requested a brief medical leave of absence to undergo treatment, the JJC denied her request and forced her to take a disability retirement. Despite Ms. Pritchett’s numerous requests to return to work, the JJC refused to allow her to return.

After a two-week trial, the jury entered the $11.8 million verdict, which included $1,249,111 for past and future economic damages, $575,000 for emotional distress and $10 million for punitive damages.

On May 23, 2017, Kevin Costello, founding partner of Costello & Mains, LLC, sat on a panel for the Camden County Bar Association Seminar on Special Education Disputes. Kevin spoke of the intersection between education rights, which arise under administrative law, and civil rights, which are under the State/Federal law and also discussed the New Jersey Law Against Discrimination. Kevin also went into detail about the relationship between schools, students and issues with special education.

"A lot people don't realize that schools can be guilty of discrimination," says Kevin, "Parents have an opportunity to not only enforce education plans administratively, but also to hold the school accountable under the civil rights laws."

On May 17, 2017 , Kevin Costello, founding partner of Costello & Mains, LLC, sat on a panel for a Camden County Bar Association Seminar and spoke on " New Jersey Employment Rights: What Are They Anyway?" This seminar was geared towards educating attorneys with little to no employment law experience, correcting some myths as to what is and isn't legal with employment in our State.

"There are so many misconceptions and so much misunderstanding when it comes to what is legal in employment law," says Kevin, "This seminar exploded some myths that are out there so that attorneys can properly advise their clients on their rights. It is always an honor to teach at CLE seminars."

A New Jersey Superior Court Judge held on Friday, January 6th, 2017, that a student has a right to bring a claim under the New Jersey Civil Rights Act when she is non-discriminatorily harassed, intimidated or bullied at school by teachers and administrators.

DEBORAH L MAINSThe firm is deeply gratified to announce an important victory before the New Jersey Supreme Court in the matter of Puglia v. Elk Pipline. Lower courts had dismissed Mr. Puglia’s claim that he was terminated in retaliation for objecting to illegal wage practices, ruling that his claim should have proceeded under federal labor law. The lower court rulings would have denied Mr. Puglia the protection of our New Jersey Whistleblower law simply because of his union membership. We continued to fight for Mr. Puglia, taking his case to the New Jersey Supreme Court, which overturned the lower court rulings and allowing Mr. Puglia to try his case before a jury.

CLE Seminar - Women in the Workplace: Legal Rights and Remedies

Costello & Mains hosted its second CLE seminar on June 2, 2016 at the Westin Hotel in Mt. Laurel. The seminar, for the benefit of non-employment attorneys, was titled "Women in the Workplace: Legal Rights and Remedies" and provided a survey of employment rights for women in the workforce in New Jersey. The seminar addressed the employer’s duty to provide a safe workplace, equal pay rights for women, women’s issues and family leave rights, gender and discrimination under the New Jersey Law Against Discrimination, and a survey of pregnancy rights and legal issues for women in New Jersey. Costello & Mains donated all of the seminar registration proceeds to the New Jersey Association for Justice (NJAJ).

On April 27, 2016, Kevin Costello, founding partner of Costello & Mains, LLC, sat on a panel for the New Jersey State Bar Association’s Institute for Continuing Education (ICLE) seminar entitled "Effectively Using Objections at Depositions and Trial: A Crash Course from Some of the State’s Top Legal Professionals." Kevin spoke on "The Art of Depositions: It’s About Goals and Objections." He focused on the reasons why you take deposition, how to prepare and how to properly execute the deposition.

"As a trial lawyer, it’s important to have the proper strategy when preparing to litigate a case," Says Kevin. "You need to have the proper weapons when going into battle, and conducting a productive deposition is just one tool that will help you successfully litigate a case. It’s important that lawyers are trained to use those tools, and I’m happy I was able to serve on this panel with some of my esteemed colleagues."

"Bullying isn't a new topic, it's just expanded in a way that never before seemed possible with advancements in technology," says Kevin. "Technology has made it easier to bully. You don't have to be face-to-face anymore to be a bully. With a click of a button you can become a bully and in an instant, make someone a victim. That, unfortunately, carries over to the school atmosphere but, with the proper actions taken by school administrations and with diligent and attentive parents, we can hope for a decrease in school bullying."

The topic of school bullying was discussed for the entire segment. "It was an honor to appear on Dr. Nace's show and I look forward to future appearances on such important subjects."

"I'm always happy to serve on the Faculty for a CLE event," says Kevin. "It's important that lawyers are educated on their ethical obligations when dealing with emotional clients. It's not always easy dealing with highly emotional situations, so it's important that attorneys have the proper tools and the knowledge to help their clients and themselves in those challenging situations."

CLE Seminar - What Non-Employment Lawyers Need to Know

Costello & Mains hosted its first CLE seminar in Atlantic City at the Sheraton Hotel on July 9, 2015. The seminar, titled "What Non-Employment Lawyers Need to Know", introduced some of the common employment causes of action recognized in New Jersey and what questions to ask clients to identify such matters. The seminar also addressed how to give sound initial advice to clients and how to recognize causes of action when a client isn't aware they have one. Costello & Mains donated all of the seminar proceeds to the New Jersey Association for Justice (NJAJ). We at Costello & Mains share the joy and pride that tens of millions of our fellow American are feeling as we hear about this historic decision. As expected, the decision was 5 to 4, and it runs the anticipated ideological lines. We’ll have more once we’ve analyzed the decision and the dissents. For now, however, the United States moves one step closer to a society in which bigotry is against our national law just as it is an affront to our national conscience.

This seminar was designed to educate attorneys and legal staff on the legal issues surrounding student restraint and behavioral issues in the school setting.

"I’m always happy to serve on the Faculty for a CLE event," says Kevin. "It’s important that lawyers know the legal rights related to behavioral issues with students, as well as student restraints. Situations occur at school and students and teachers need to be kept safe. Kevin Costello Serves As Keynote Speaker At NJAJ Event

Kevin Costello, Third Vice President of the New Jersey Association for Justice (NJAJ), was a keynote speaker at an NJAJ event honoring Paul D. Moriarty, Chair of the New Jersey Assembly Consumer Affairs Committee, an event which also offered a CLE presentation to consumer and employment attorneys. Kevin discussed the state of Rendine fee applications in light of recent decisions.

"The Rendine decision is a very important one for workers and consumers," says Kevin Costello, "because the risk of a Court shifting a plaintiff attorney’s fees to a defendant business should encourage the business to comply with New Jersey whistleblowing, anti-discrimination, family leave, overtime and consumer laws, rather than answer before a Court."

The Gender Spectrums Support Network is a network designed to support, encourage, and empower the trans* and gender diverse community in Monmouth, Middlesex and Ocean counties. "I have a special passion for civil rights, and that includes advocating for and protecting the rights of the LGBT community," says Kevin. "I continually support initiatives to expand civil rights generally, and to expand LGBT rights specifically. It was an honor to speak to the Gender Spectrums Support Network."

Kevin M. Costello Interviewed regarding Sexual Harassment suit in Williamstown and the Impact of Technology

Kevin Costello, the founding member of Costello & Mains in New Jersey, was interviewed by the South Jersey Times regarding sexual harassment in schools and the impact of technology. The interview is in follow-up to an article regarding a complaint that was recently filed against Williamstown School District and a 6 th grade female student alleging severe sexual harassment. "Bullying and harassment is far more damaging than it ever was, and it's getting worse, because technology makes it worse," Kevin said. "It's far easier to recruit help, far easier to socially ostracize the victim and far more daunting, although not impossible, for parents and schools to control behaviors." Kevin continued, "To stop the problem, you have to stop kids from thinking these things are okay, to make sure that early on, if kids are engaging in this conduct, it's required that kids be subject to discipline."

New Jersey Employment and Civil Rights Attorney Speaks With Transgender Client About Police Discrimination Case

Kevin Costello, the founding member of Costello & Mains law firm in New Jersey, was interviewed, along with the firm's transgender client, by The Record regarding a police discrimination case filed by the firm for Amira Gray. The suit alleges that Ms. Gray was pulled over while driving through North Bergen and was humiliated by the manner in which she was handled by the police, for example, being called "sir" despite the fact that her license said "female" and despite her appearance as a young woman.

"New Jersey's Law Against Discrimination prohibits discrimination based upon gender identity or expression," says Kevin, "which means that, in the eyes of the law, she's a woman when she says she is. And once she declares that's who she is and that's how she presents herself, the police are obligated to treat her that way regardless of what her license marker says. "In the eyes of the Law Against Discrimination, she's a woman," Kevin adds.

New Jersey Employment Lawyer Kevin Costello Wins Sexual Harassment Trial in Camden County

Employment Rights Attorney Kevin M. Costello, Esq., a member in the New Jersey Employment Rights Law Firm of Costello & Mains, obtained a $150.000.00 verdict in a sexual harassment trial concluded in Camden County, New Jersey, on February 7, 2014. "We're very proud of the result," Kevin says, "because this case was hard-fought. At no time did these defendants want to discuss settlement, and they were aggressive in offering witnesses and evidence suggesting the harassment didn't occur.

The case involved sexual and racial harassment directed at a female server by her employer, the owner of a south Jersey dining establishment. "Some pretty awful language was at issue," Kevin says, "though the defendant, along with his witnesses, denied that it happened." As well, the plaintiff in the matter contended that she was discharged in retaliation for resisting the harassment, and that she lost several weeks of work as a result. The final verdict was in the amount of $50,000.00 in compensatory damages and an additional $100,000.00 in punitive damages. An application for additional damages for the plaintiff's attorney fees is also pending.

New Jersey Employment Rights Attorney Discusses Raising the Minimum Wage

In the November elections, NJ voters voted, with 61% in support, to amend the NJ State Constitution to increase the minimum wage, effective January 1, 2014, from $7.25 per hour to $8.25 per hour. The amendment will also require annual increases to the minimum wage in the event of a cost of living increase. NJ has become just the fifth state in the union to make the minimum wage a matter of constitutional mandate.

"I am pleased that Senator Nia Gill, has proposed this Bill," Kevin says. "The change is necessary in an economy where increasing numbers of particularly vulnerable younger people offer work without compensation in order to gain experience, references and 'rep' in the work world. It's a 'no-brainer,' since I don't believe anyone could reasonably suggest that it's 'OK' to sexually harass a female intern simply because she's not collecting a paycheck. Her work is no less valuable than those who are compensated and her rights are no less precious."

Member Kevin Costello Speaks at Rowan University Symposium on December 18, 2013

Costello & Mains Member Kevin Costello was a guest at a Symposium of legal minds, students, faculty and other professionals in the field of Employment and Civil Rights at Rowan University on December 18, 2013. The purpose of this Symposium was to engage in a Socratic dialogue, using examples and vignettes, to discuss the impact of recent revisions to Title IX of the Federal statutes, along with extant Civil Rights Laws under Title VII of the Federal Civil Rights Act and the New Jersey Law Against Discrimination.


New Jersey School Harassment and Bullying Lawyer Appears on NBC 10 to Discuss School Harassment and Bullying

Kevin Costello, founding member of Costello & Mains in New Jersey, a statewide school bullying and harassment, employment rights and civil rights law firm, was interviewed by Philadelphia’s NBC News 10. The interview concerned recent filings regarding school harassment and bullying, including the case of J.F. v. West Deptford Public Schools. "We’ve seen a steady increase in these types of cases," Kevin says, "and technology isn’t helping. It’s become very easy to passive-aggressively harass someone remotely using social media and applications that allow false video and pictures. The specific types of homophobic, sexual and racial harassment we’re seeing is often devastating to the kids affected, as well as to their families. It destroys school morale and can destroy lives."

New Jersey Employment and Civil Rights Attorney Serves as Chairman for New Jersey Association for Justices Employment CLE Program

Costello, currently an Officer of the Executive Committee of the Board of Governors of the New Jersey Association for Justice, served as the Chairman of the Association’s "Meadowlands Seminar," an annual legal CLE event which took place in North Jersey between November 13 and November 14. Kevin was the Chairman for the Employment and Labor Program. "I am always happy to serve as a Chair or as Faculty for a CLE Event," Kevin explains. "This is really, secretly, a way to learn while one teaches. It is always great to share hard – 1 information and wisdom with the next generation of Employment Rights Trial Lawyers."

The law firm of Costello & Mains, in conjunction with the New Jersey Association for Justice, hosted a "Social Justice Mixer" at the Teno Restaurant in Westmont, New Jersey on Thursday, November 21, 2013. Costello & Mains Member Kevin Costello Wins CEPA Trial in Ocean County
On October 10, Kevin and his co-counsel took a CEPA verdict for their client in a tough-fought matter under the New Jersey Conscientious Employee Protection Act, also called New Jersey's "whistleblower" law. "We're very pleased," Kevin says of the verdict. "This was a case in which there was no quarter asked, and none was given. The defense refused to talk settlement and was of the firm belief they'd be able to convince the jury that our client was fired for non-retaliatory reasons. We disagreed, and we prevailed. Our client is pleased to have been vindicated by the jury."

Costello & Mains member Kevin M. Costello, who focuses his state wide trial practice in Employment and Civil Rights, announced, on behalf of the Costello & Mains Firm, unconditional support for the recent decision by the New Jersey Supreme Court effectively, and at long last, legalizing same-sex marriage in New Jersey. "Even though Governor Christie unwisely opposed the decision on the grounds that 'Civil Union Law' doesn't deny any benefits, he's now withdrawn that opposition, ending the long nightmare of gay people in New Jersey who were told that their marriage rights were inferior to those of traditional couples. As a civil rights lawyer and long-outspoken supporter of equal rights under the law, I celebrate and support the Court's decision."

On October 9, 2013, Costello & Mains member Deborah L. Mains spoke to and answered questions by Law Students who have an interest in representing individuals in labor and employment matters. "I was honored to be invited to address the Labor and Employment Law Society at my alma mater. It was a pleasure to meet the students and encouraging to me to see so many law students committed to preserving individual rights and assisting the victims of the unlawful employment practices." Ms. Mains is a 1995 graduate of the Rutgers University School of Law – Camden.

Costello & Mains Preserves $2.14 Million Verdict
Costello & Mains members Deborah L. Mains and Kevin M. Costello argued in opposition to a motion for a new trial in the matter of Doculan v. Bayonne Medical Center and won the day, preserving the significant verdict in Conscientious Employee Protection Act (CEPA) case obtained in a trial by Kevin in Hudson County in May. "We're very proud of the verdict, of course," says Kevin, "but having had the motion to set the jury's verdict aside properly denied by the Court is gratifying. It demonstrates the respect for the jury's deliberative process and the right of a trial by jury." Deborah adds: "Our client is very happy with the result."

Costello & Mains Files Appeal of the "Borgata Babes" Dismissal
The firm fought – and for the moment, lost – a motion to dismiss the suit on behalf of a score of "Borgata Babes" cocktail servers who claim discrimination at the hands of the casino emerging from appearance policies. The contention in the case is that requiring a certain type of sexualized appearance for a job which should not fairly require such is a violation of New Jersey's Law Against Discrimination. The casino asked the Court to dismiss the case on the grounds that the policy is not discriminatory, and the Court agreed. "We respectfully believe the decision was wrong," says member Deborah Mains, who authored the brief and undertook the argument, "and we plan to appeal, because we believe that sexualizing a job is a form of gender discrimination illegal under state law. We will not give up this fight until it's through the process."

Costello, was a chair of the New Jersey Association for Justice's "Boardwalk Seminar," a continuing legal education event designed to further the litigation and trial skills of New Jersey plaintiff employment rights attorneys. "I've chaired the section for NJAJ and this seminar for about six years now," Kevin says, "and I'm always thrilled to do it. My dirty little secret is that when I teach the law, I learn my craft better, so I'm really also teaching myself." Kevin is also an executive officer of the New Jersey Association for Justice.
