Military Service Harassment

Military service is an honored service and calling. Yet some employers resent the inconvenience or intrusion, either on practical or philosophical grounds, and disrespect the employee who served, or serves, in the Coast Guard, Army, Air Force, Navy or Marines. They create or permit a hostile, intimidating or abusive working environment based on the employee’s military service that might take the form of abuse, negative references to the time off needed for service, the “politics” of military service, or other behaviors that belittle and abuse the commitment and sacrifice the uniform requires.

The Uniform Services Employment and Re-Employment Rights Act, commonly referred to as USERRA, and the New Jersey Law Against Discrimination, prohibit this type of workplace harassment based on military service not only for the Army, Navy, Air Force, Marines and Coast Guard, but also for service with the National Guard and Reserves.
