Creative Solutions

The laws regarding student rights, discrimination and harassment are, in some ways, in their infancy. It is often necessary to be creative in fighting for justice for students. We are not afraid to try a novel approach if that will help us protect your child. Our firm has even used the New Jersey Civil Rights Act to address the impairment or denial of a student’s constitutional right to a “free and appropriate public education” (FAPE) where there is no illegal discrimination.

When a school, either through its personnel or by ignoring the conduct of students, causes a student’s right to a free and appropriate public education to be diminished or impaired, and when a student suffers damages, we’ve used the New Jersey Civil Rights Act to hold districts accountable for those damages.

These legal issues are new and challenging. As far as we know, we are among the few firms attempting to use the Civil Rights Act in this fashion. We’ll do what we think is appropriate and best to address a student’s injuries arising from interference with his or her constitutional rights in a school setting.
