Discrimination By Police Or Law Enforcement

New Jersey law has held that even if you’ve committed a crime, and even if the police are arresting you properly, they must not treat you in a fashion that is discriminatory based on race, sex, ethnicity, national origin, religion, creed, sexual orientation, gender identity or gender expression, or other protected classifications. They must not make arrest and processing decisions upon these criteria, or treat you in a hostile or abusive fashion, even when they have a proper reason to interact with you.

These prohibitions upon discrimination by police or government officials in the course of conducting official business even extend to when the police are on the move. Wherever they go, the Law Against Discrimination goes with them, and they must obey it.
